1) RealEstateColorado.Net, Inc. maintains a website on which property owners/managers ("Lessors") may, subject to certain terms and conditions, place information about their properties for view by potential tenants ("Renters"). By submitting a request to post properties on RealEstateColorado.Net, Inc.'s website, you are agreeing to be bound by these terms and conditions.
2) Posting rental properties on RealEstateColorado.Net, Inc.'s website is intended to allow Lessors to advertise properties to Renters and allows Renters to review postings and to communicate with Lessors. Please note that RealEstateColorado.Net, Inc. may make changes to its website at any time without notifying you or receiving your consent.
3) Your property posting on the RealEstateColorado.Net, Inc. website is solely for the purpose of describing a particular rental property for rent and may not contain any links to other websites nor reference to such links. Only Residential property for rent may be displayed not for sale, rent to own, or lease option, strictly for rent only. If you violate this rule, RealEstateColorado.Net, Inc. shall be authorized and entitled to delete your posting from the RealEstateColorado.Net, Inc. website without any notification. You further agree that you will use the RealEstateColorado.Net, Inc. website solely for the purpose of legitimately Advertising, and making legitimate offers concerning, your properties, and that you will abide by any in accordance with any rules and procedures that may be established from time to time by RealEstateColorado.Net, Inc. regarding the use of the RealEstateColorado.Net, Inc. website.
4) Property postings are valid for 365 days. RealEstateColorado.Net, Inc. will make reasonable efforts to ensure that your property posting remains on RealEstateColorado.Net, Inc. website for the full 365-day period. You recognize and agree, however, that RealEstateColorado.Net, Inc. may remove your property posting from its website without making any refund before the expiration of this 365-day period where in RealEstateColorado.Net, Inc. sole discretion RealEstateColorado.Net, Inc. believes it is necessary or appropriate to do so.
5) RealEstateColorado.Net, Inc., makes reasonable efforts to, and intends to comply with, state and federal civil rights laws, including the Fair Housing Act and the Americans with Disabilities Act. You agree to comply with such acts and you shall not state or apply any preference based on race, color, national origin, religion, handicap or any other category in connection with your use of the RealEstateColorado.Net, Inc. website or any property posted on this website. You hereby agree to defend and indemnify RealEstateColorado.Net, Inc. from and against any claim asserted by any party that arises out of or relates in any way to your posting or any action taken by you in connection with any inquires that you receive as a result of or in connection with your posting. While RealEstateColorado.Net, Inc. makes all reasonable effort to comply with state and federal civil rights laws, RealEstateColorado.Net, Inc. does not monitor transmissions of information or other actions by Renters and/or Lessors or other persons who may access or use the RealEstateColorado.Net, Inc. website, and RealEstateColorado.Net, Inc. assumes no liability for any such person's failure to comply with such laws. Additionally, RealEstateColorado.Net, Inc. does not sponsor or endorse, and is not responsible for the content of, any third-party websites to which you may link using this website
6) In connection with your posting of properties on or other use of RealEstateColorado.Net, Inc.'s website, you acknowledge and agree that RealEstateColorado.Net, Inc. has not participated in, and will not be expected to participate in: (a) any inspection of rental properties; (b) any verification of the accuracy of information contained in the posting of your property or any offers or proposals submitted in connection with your property; (c) any actual lease transactions, including, without limitation, negotiations, discussions, or proposals concerning any proposed or consummated lease transaction; or (d)rendering or otherwise providing any legal, or other professional advice or services.
7) You agree to indemnify, defend and hold RealEstateColorado.Net, Inc, and its affiliates, licensors and suppliers, harmless from and against any claims, liability, loss, and/or expense, including reasonable attorney's fees, related to your violation of this Agreement and/or your use of this website.
8) RealEstateColorado.Net, Inc., does not warrant or otherwise guarantee the accuracy of any information available on the RealEstateColorado.Net, Inc. website, and is not responsible for any errors, omissions, or misrepresentations, whether made by Lessors, Renters or otherwise. ALL INFORMATION YOU RECEIVE FROM RealEstateColorado.Net, RENTERS, AND/OR THE USE OF the RealEstateColorado.Net WEBSITE, IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. RealEstateColorado.Net, Inc., HEREBY DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. RealEstateColorado.Net, INC, DOES NOT WARRANT THAT ANY DATA YOU RECEIVE FROM RealEstateColorado.Net OR ANY RENTER WILL BE ACCURATE, COMPLETE, UNINTERRUPTED OR ERROR FREE OR THAT ANY INFORMATION, SOFTWARE, OR OTHER MATERIAL ACCESSIBLE FROM OR RELATED TO THE RE WEBSITE IS FREE OF VIRUSES, WORMS, OR OTHER HARMFUL COMPONENTS. You are solely responsible for verifying to your satisfaction the accuracy of any and all of the information contained on the RealEstateColorado.Net, Inc. website.
9) RealEstateColorado.Net. Inc.'s maximum liability under this Agreement is limited to the return of your posting fee for a single 365-day period. Since no posting fee is collected. The maximum liability is zero dollars. UNDER NO CIRCUMSTANCES SHALL RealEstateColorado.Net, Inc., OR ITS AFFILIATES AND/OR SUPPLIERS, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES OR LOSSES ARISING OUT OF OR RELATED IN ANY WAY TO THE USE OF THIS WEBSITE, INCLUDING, BUT NOT LIMITED TO (i) THE USE OF THE RealEstateColorado.Net, Inc. WEBSITE; (ii) ANY DELAY OR INABILITY TO USE THE WEBSITE; OR (iii) THE INACCURACY OR OTHER DEFECT IN ANY INFORMATION, PRODUCTS, OR SERVICES OBTAINED THROUGH THIS SITE OR OTHERWISE FROM RealEstateColorado.Net, Inc.
10) By requesting that information concerning your property be posted on the RealEstateColorado.Net, Inc. website, you agree to abide by the RealEstateColorado.Net, Inc.'s policies, as they now exist and as they may be amended in the future.
11) You understand and agree that RealEstateColorado.Net, Inc. is merely a passive conduit for the online distribution and publication of any materials, information or data that you provide in any form to RealEstateColorado.Net, Inc., Renters or other persons in the course of your use of the RealEstateColorado.Net, Inc. website. In order to facilitate and allow RealEstateColorado.Net, Inc. to post your property on the RealEstateColorado.Net, Inc. website, you hereby grant RealEstateColorado.Net Inc a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise any intellectual property and publicity rights (but no other rights) you have in any information or rights that you disclose to RealEstateColorado.Net, Inc., in any media now known or that becomes known in the future, and to allow RealEstateColorado.Net, Inc to use any trademarks, service marks or trade names provided by you to RealEstateColorado.Net, Inc. pursuant to this agreement in order to properly identify buildings owned or managed by you.
12) RealEstateColorado.Net, Inc. provides all users with the opportunity to correct, update or delete information stored in their account. 13) By entering into this Agreement, you hereby represent and warrant that: (a) you will not transmit to RealEstateColorado.Net, Inc., any Renter or any other person any information or materials of any kind which (i) infringe on or otherwise violate the intellectual property or contractual rights of any other person; (ii) contain libelous, defamatory, obscene, pornographic, abusive or otherwise unlawful material; or (iii) contain any viruses, Trojan horses, worms, time bombs, cancel bots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (b) your use of our website and services will at all times comply with all applicable laws, rules, and regulations; (c) you will take no action that would directly or indirectly cause RealEstateColorado.Net, Inc. to lose (in whole or in part) access to and use of the services of RealEstateColorado.Net, Inc. website or the services of RealEstateColorado.Net, Inc.'s internet service providers or other suppliers; (d) you have the power and authority to enter into this Agreement: if you are an individual, this includes, without limitation, that you are of the legal age in your state of residence to make contracts; (e) you are owner of, or you are an employee, agent or representative of the owner of any properties that you post on the RealEstateColorado.Net, Inc. website, and you have the authority to negotiate a Lease Transaction on behalf of the properties; and (f) all information supplied or to be supplied by you relating to your use of the RealEstateColorado.Net, Inc. website and/or any properties that you post on the website is and will be accurate and complete.
14) RealEstateColorado.Net, Inc. may amend this Agreement (including, without limitation, the Terms of Use Agreement and/or its Fees and Policies at any time by email or by posting the amended terms on the RealEstateColorado.Net website. Except as otherwise provided herein, changes to this Agreement are effective thirty (30) days after we provide you with notice of the change by email or post a notice on the website. This Agreement may not otherwise be amended except in a writing signed by both parties.
15) You and RealEstateColorado.Net, Inc are independent contractors, and no agency, partnership, joint venture, or employee-employer relationship is intended or created by this Agreement. By allowing you to post properties on the RealEstateColorado.Net, Inc. website, RealEstateColorado.Net, Inc. is not undertaking, and shall not owe, any fiduciary duties to either Renters or Lessors.
16) Except as explicitly stated otherwise, any notices shall be given by email to info@RealEstateColorado.Net or to the email address you provide to during the registration process (in your case), or such other address as the party shall specify. Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, RealEstateColorado.Net, Inc. may give you notice by United States mail, postage prepaid, to the address you provided to RealEstateColorado.Net, Inc. during the registration process. In such case, notice shall be deemed given three (3) days after the date of mailing.
17) THIS AGREEMENT IS GOVERNED BY THE LAWS OF THE STATE OF COLORADO AND ANY APPLICABLE FEDERAL LAWS, WITHOUT GIVING EFFECT TO CONFLICT OF LAWS PRINCIPLES. ANY LEGAL ACTION OR PROCEEDING UNDER THIS AGREEMENT SHALL FIRST BE SUBJECT TO ARBITRATION. ANY ARBITRATION SHALL TAKE PLACE IN DENVER, COLORADO. ARBITRATION SHALL BE GOVERNED BY THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION. ARBITRATION SHALL BE THE SOLE REMEDY AVAILABLE TO YOU UNDER THIS AGREEMENT. THE ARBITRATOR SHALL HAVE NO AUTHORITY TO AWARD PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT UNDER ANY CIRCUMSTANCES WHATSOEVER.
18) In the event that any provision of this Agreement is determined by a court to be invalid or otherwise unenforceable, such provision (or portion thereof) shall be enforced to the extent possible consistent with the stated intention of the parties, or, if incapable of such enforcement, shall be deemed to be deleted from this Agreement, while the remainder of this Agreement shall continue in full force and remain in effect according to its stated terms and conditions.
19) You hereby represent and warrant that prior to agreeing to be bound by these terms and conditions you had the opportunity to seek the advice of an attorney, if you so desired.
